Contract basicsContracts and BMP'sContracts also usually include explanations and requirements for Best Management Practices (BMPs) use for the harvest operation. As defined by the Tennessee Division of Forestry, BMPs "are practical, non-regulatory guidelines to be used during the construction of roads, log landings, and skid trails to minimize the environmental impact of forest management activities." These guidelines help landowners and loggers to protect water quality during forest operations with methods that are inexpensive, practical, and are easy to implement. Contract provisions dealing with BMPs generally include specifications concerning conditions when logging will not be permitted (wet weather); locations of roads, skid trails, and landings; protection of remaining timber and property; and erosion control measures such as re-seeding of roads and landings and construction of water bars. Most contracts include provisions for performance bonds supplied by the buyer to ensure that if any of the conditions of the contract are not fulfilled, the value of such violations or damage is deducted from the bond. Each state has its own set of BMP's so be sure to contact your state's forestry agency to get a copy specific to your location.
